How Our Fees Are Determined.

Whenever it is practical to do so, we provide our estate planning services for a fixed fee, as opposed to hourly billing. When we meet, we will provide upon request a schedule setting forth the range of our Basic Fees and Supplemental Fees for estate planning services for 2008. These fees reflect (i) the value of the services provided, (ii) the level of expertise required, and (iii) the anticipated time and effort involved on our part.

Fees for Basic Services.
Most of our clients needs are met by the services provided for the Basic Fee. These services include:

· Review of the client’s current financial picture and estate planning documents.

· Recommendation of a comprehensive estate plan, including suggestions as to changes in asset ownership and beneficiary designations.
· Preparation of the following documents for the client:

-Last Will and Testament
-
Revocable Trust Agreement
-
Financial Power of Attorney.
-Advance Medical Directive (includes Medical Power of Attorney).

· Recommendations as to correct beneficiary designations on life insurance policies and retirement plan accounts (e.g., IRA, 401-k, and TIAA-CREF).

· Supervised execution of estate planning documents.

· Delivery of documents to clients in a personalized binder.

 

The Initial Meeting.
The Basic Fee includes the cost of the initial estate planning meeting. It is our practice to agree with our client on a fee prior to the preparation of drafts of documents. We do not to charge a person who declines to proceed after the initial meeting.

Fees for Supplemental Services.
Some clients need estate planning services and document preparation that are beyond the scope of what we provide for the Basic Fee, but which are nevertheless common in our law practice and in our community. These include Special Needs Trusts, Irrevocable Life Insurance Trusts, Limited Liability Companies (and associated Operating Agreements), Crummey Trusts (usually for a minor), and deeds changing title to real estate.

Out of Pocket Costs.
We often advance the costs of filing fees and overnight mail charges. We bill for these charges along with our fees. We do not seek to recover travel expenses within Charlottesville-Albemarle, long distance telephone charges, or photocopying costs.

Hourly Billing.
There are times when we will not be able to handle a matter on a fixed fee basis. In those circumstances, with the client's consent, we will charge a fee based upon the hourly billing rate of the attorney or the paralegal assigned to the matter. For 2008, our hourly billing rates for Thomas Nolan will be $225 per hour, and for April R. Fletcher will be $200 per hour. We generally do not involve our paralegals in the estate planning process.
